Services:Nevada Legal Services staff in the Carson City Office provide legal services in civil (not criminal) matters involving Indian law issues to eligible Indian people and Indian Tribes.

Nevada Legal Services may be able to help individuals with the following problems: a state social service agency or state court has taken your child from you, a state court is trying to garnish your on-reservation earned wages, you need to give a relative temporary legal authority to take care of your child, you are an Indian who was adopted and now wish to know your Tribal affiliation, you are being evicted and the Indian Housing Authority is not following its own rules, you have been served with legal papers from a non-Tribal court while you were on a reservation, your property was repossessed while it was on the reservation, you live on a reservation and a state is trying to get child support from you in state court, a state official is trying to enforce a state law against you while you are on a reservation, you are having problems exercising your Indian religion, you are a Tribal elder and would like advice concerning financial or health matters, or you as an Indian are being charged a state tax for activities on a reservation, or you are a tribal elder and you need a will.

Nevada Legal Services may be able to help Tribes with the following legal matters: asserting Sovereign Immunity against an outside entity, jurisdictional disputes with other governments (federal, state, county, and/or city), intergovernmental agreements, environmental law, hunting and fishing rights, water law, Bureau of Indian Affairs contracting issues, Indian Child Welfare Act, jurisdictional issues, economic development, cultural resources/sacred site protection, religious freedom, tax issues, land disputes, constitutional and code revision, and applicability of general federal laws.

Nevada Legal Services does NOT handle cases in the following Indian law areas: lawsuits brought by an Indian person against an Indian person or an Indian Tribe, divorce, legal separation and annulment, child support (unless there is a jurisdictional issue), child custody (unless the case involves the Indian Child Welfare Act), criminal matters (unless there is a jurisdictional issue), cases representing a person incarcerated in a federal, state or local prison.

Eligibility:Eligibility depends upon the type of legal assistance you need and your income level. To be eligible for assistance through Nevada Legal Services you must be an individual, household organization, group or Indian tribe with a low income. During your first appointment you will either be advised and/or briefly assisted by one of the advocates or you will be referred. If formal representation is requested, Nevada Legal Services staff will make that eligibility decision at a later date.
